What you'll sign in person

The full release below is what a parent or guardian signs on a printed copy at the first session. Please read it ahead of time.

01Activity

The participant will take part in private baseball instruction, including hitting, fielding, throwing, and related conditioning and drills, conducted by Provider at the training facility and any other facility Provider designates.

02Acknowledgment & assumption of risk

I understand that baseball instruction involves physical activity and carries inherent risks, including but not limited to being struck by a ball, bat, or equipment; collisions; slips, trips, and falls; muscle strains, sprains, fractures, and other injuries; and, in rare cases, serious injury. I understand that these risks cannot be eliminated regardless of the care taken.

Knowing these risks, I voluntarily choose for the participant to take part and accept and assume all such risks, both known and unknown.

03Release of liability

I, on behalf of myself and the participant, RELEASE, WAIVE, AND DISCHARGE Penders Baseball School LLC, its owner Rob Penders, and its employees, instructors, and agents (collectively "Released Parties") FROM ANY AND ALL LIABILITY, CLAIMS, OR DEMANDS FOR INJURY, DEATH, OR PROPERTY DAMAGE ARISING OUT OF OR RELATED TO THE PARTICIPANT'S PARTICIPATION, INCLUDING CLAIMS CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, to the fullest extent allowed by Texas law.

This release does not apply to gross negligence or intentional or reckless misconduct.

04Indemnification

I agree to indemnify and hold harmless the Released Parties from any claim, loss, or expense (including reasonable attorney's fees) brought by or on behalf of the participant arising out of the participant's participation, except to the extent caused by the Released Parties' gross negligence or intentional misconduct.

05Medical authorization

In the event of injury, I authorize the Released Parties to secure emergency medical treatment for the participant if I cannot be reached. I am responsible for any resulting medical costs. I confirm the participant is physically able to take part and has no condition that would make participation unsafe, except as disclosed above.

06Facility

I understand that the training facility is a separate business and that this release covers the Released Parties named above. Use of the facility may be subject to the facility's own terms.

08Governing law & severability

This agreement is governed by the laws of the State of Texas. If any part is found unenforceable, the rest remains in full effect. Venue for any dispute is Travis County, Texas.

09Acknowledgment

BY SIGNING IN PERSON, I CONFIRM I HAVE READ THIS WAIVER AND RELEASE, FULLY UNDERSTAND ITS TERMS, AND SIGN IT FREELY AND VOLUNTARILY. I UNDERSTAND I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING THE RIGHT TO SUE, ON BEHALF OF MYSELF AND THE PARTICIPANT.

I have read the release above and understand that a parent or legal guardian must be present at the first session to sign a printed copy in person, which will be witnessed and countersigned.
